Please read these Terms and Conditions ("Terms") carefully before using the Matrios mobile application ("App") and associated electric vehicle charging services ("Services").
1.1. Acceptance: By downloading, installing, accessing, or using the App and the Services, you ("User", "you", or "your") agree to be bound by these Terms, the Privacy Policy, and any other policies or guidelines referenced herein. If you do not agree to these Terms, you must not use the App or the Services.
1.2. Modification: Matrios reserves the right to modify or replace these Terms at any time. We will notify you of material changes via the App or email. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
2.1. Eligibility: You must be at least 18 years of age and capable of entering into a legally binding contract under applicable law.
2.2. Account Registration: You must register for a User Account to use the Services. You agree to provide accurate, complete, and current information.
2.3. Security: You are responsible for maintaining the confidentiality of your account credentials (password, OTP, etc.). You are solely responsible for all activities that occur under your User Account, and Matrios is not liable for any loss or damage arising from your failure to protect your credentials.
2.4. Scope of Service: Matrios acts as a technology platform to connect Users with available electric vehicle charging points operated by Matrios or its partners/Charging Point Operators (CPOs). Matrios is responsible for the performance of the App and payment processing, but disclaims liability for the physical charging infrastructure, its uptime, condition, or compatibility with your vehicle.

4.1. Availability: Matrios provides real-time availability information, but does not guarantee the accuracy of this data or the functioning of the hardware.

4.3. Idle Fees: To promote efficient use, Matrios or its CPO partners may implement an "Idle Fee" that will automatically be levied from your Wallet if your vehicle remains connected to the charger after the charging session is complete.
4.4. Damage: You will be liable for any damage to the charging station or property caused by your vehicle, negligence, or misuse. Matrios reserves the right to charge such repair or replacement costs to your Wallet.
5.1. Termination by Matrios: Matrios may terminate or suspend your access to all or part of the Services immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms, engage in fraudulent activity, or violate the Fair Usage Policy.
5.2. Effect of Termination: Upon termination, your right to use the Services will immediately cease, and your Wallet balance will be forfeited as per Section 3.2(c).
6.1. Disclaimer: The App and Services are provided on an "AS IS" and "AS AVAILABLE" basis. Matrios makes no warranties, whether express or implied, regarding the continuous, secure, or error-free operation of the App or the condition, safety, or availability of any third-party charging station.
6.2. Limitation of Liability: In no event shall Matrios, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or other intangible losses, resulting from:
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Jodhpur.
